Declaration Overview

The Kiwanda Shores Planned Unit Development is governed by the Amended and Restated Declaration recorded under the Oregon Planned Community Act. The protective framework ensures the preservation and enjoyment of the natural environment while fostering appropriate individual expression for property owners.

Key Provisions & Covenants

Use & Property Maintenance

Lots are restricted strictly to single-family residential use. Property owners are required to maintain their lots to standards set by the Board of Directors; failure to do so allows the Association to perform necessary maintenance and bill the lot owner.

Architectural Controls

All exterior construction, modifications, landscaping, fences, and outbuildings require prior written approval from the Architectural Control Committee (ACC). Key guidelines include:

Assessments & Voting

Each lot is allocated one vote in Association affairs. Common expenses and reserve funds are assessed equally across lots (unimproved lots may receive discounts at the Board's discretion). Unpaid assessments accrue late fees, surcharges, and interest, and may result in property liens.

Common Property & Restrictions

Common area maintenance is managed by the Association. No lot subdivision is permitted. Outside antennas, utility line installations, and unauthorized signage are restricted without prior approval.
